ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 100,000.
The judgment of the Madras High Court records the following account. On 7 May 2004, Pandalkudi police personnel led by SI dragged serving Army officer Captain Ganesan from his car and beat him with iron rods in a savage manner after an altercation at Danalakshmi lodge; his father and an advocate were also beaten. The RDO Aruppukkottai enquiry under PSO 151 found grievous injuries caused by excessive police force, and the NHRC found the assault and torture true, recommending Rs.1 lakh interim relief. The State paid Rs.1 lakh (G.Os. Ms. 232/2008 and 610/2008) and ordered recovery from the five policemen. The court dismissed their writ petitions, holding the recoveries from salaries shall continue without prejudice to the pending departmental action and NHRC proceedings.
