Sadulshahar Police Constable vs State of Rajasthan and Others

On 02.04.1994 constables and [name withheld] escorting six accused to the MJM Sadulshahar court lost two accused (Nakli @ [name withheld] and Billu); the ASP Hanumangarh enquiry disbelieved the 'nature's call at the bus stand' defence and found [name withheld] ferried the two accused by jeep to village Alipura for extraneous reasons with [name withheld] hands-in-glove, with FIR No.83/1994 u/s 222-223 IPC also registered. The SP dismissed both constables in 1995 and the DIG dismissed their appeal; [name withheld] died during the writs, pursued by petitioner [name withheld]. The court held the findings rested on cogent material including the jeep driver and home-guard witnesses, the escape story was make-believe, and dismissal was not disproportionate where NDPS/s.302 IPC accused were let off. It dismissed both writ petitions with no order as to costs. Matters not addressed in the cited judgment text are not recorded here.
