Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Kerala High Court judgment.
The judgment of the Kerala High Court records the following account. Sub Inspector of the Lakshadweep Police Special Branch at Cochin demanded Rs.250 from labour contractor [name withheld] for issuing the police clearance certificate needed for a Minicoy Island entry permit, and accepted it in a CBI trap in March 1999. The Special Judge (SPE/CBI-II), Ernakulam convicted him under Sections 7 and 13(2) read with 13(1)(d) of the PC Act, sentencing him to 6 months and 1 year's rigorous imprisonment with fines. The Kerala High Court held the prosecution proved demand and acceptance through testimony, contemporaneous mahazars, the phenolphthalein test and the accused's conduct. The court dismissed the appeal confirming conviction and sentence, observing the trial judge had erred, if at all, on the side of leniency.
