CW-2010-0012Gurugram, HaryanaJudgment 14 December 2010

Inspector Om Parkash v. CBI; ASI Anant Ram v. CBI; Rekha v. CBI & Ors.

The Punjab and Haryana High Court dismissed the appeals of a Gurgaon CIA Inspector and ASI, upholding their 7-year sentences for torturing a Gurgaon man to death in custody after he was picked up on 9 February 1993 and transferred from Delhi to CIA Staff Gurgaon. The Court relied on the jail register injury entry, the post-mortem head injury and the destruction of two MLRs, applying the custodial-death burden shift to the custodians. It held the conviction well-founded and well-reasoned. The trial acquittals of four Delhi Police officials were left undisturbed and the complainant revision was dismissed. Matters not addressed in the cited judgment text are not recorded here.
