CW-2010-0011Chikkaballapur, KarnatakaJudgment 29 October 2010

Chikkaballapur Man vs A. B. Devaiah & Ors.

The judgment of the Karnataka High Court records the following account. On 17 January 1989, complainant [name withheld] arrived at the Chikkaballapur court premises with his advocate and surety to move a bail application in a bailable case, but was apprehended by the Sub-Inspector and three constables, dragged to the police station, assaulted with fists and boots, and subjected to electric shocks. The trial Magistrate acquitted all four policemen in 2005. The Karnataka High Court reversed the acquittal, holding that the complainant had been illegally detained and assaulted despite the offence being bailable. The High Court convicted all four police officers under Sections 341 and 323 IPC, releasing them on probation under Section 4 of the Probation of Offenders Act upon executing good behaviour bonds. Matters not addressed in the cited judgment text are not recorded here.
