ConcludedThe Gujarat High Court recorded adverse findings against police personnel and ordered Rs 100,000.
The Gujarat High Court held Hansot police grossly negligent in the lock-up death of Rameshbhai Parmar, arrested on 6 May 1995 in largely non-cognizable offences and kept overnight instead of being produced before the nearby magistrate. The Court found that after he complained of stomach pain around 1:30 a.m., he was left without medical help for over an hour while police slowly arranged a vehicle, dying at 2:47 a.m., with two unexplained ante-mortem bruises. Though the death was attributed to GI perforation rather than custodial violence, the Court held the State liable for infringing the arrestee's Article 21 rights. It partly allowed the petition, directing Rs 1 lakh compensation to the widow under Article 226. Matters not addressed in the cited judgment text are not recorded here.
