CW-2009-0025RajasthanJudgment 5 May 2009

Rajasthan Police Constable vs State of Rajasthan and Others

The judgment of the Rajasthan High Court records the following account. Constable joined the Rajasthan Police on 11 May 1973 against a Scheduled Caste vacancy on a 1969 caste certificate, and was charge-sheeted in November 2006 for obtaining the appointment by a false certificate. The court recorded that he first denied the charge but admitted guilt in writing on 16 December 2006, and was awarded withholding of pension from his 31 December 2006 retirement, affirmed on appeal in June 2007. The court held the appointment was void ab initio and that no penalty less than dismissal was proportionate, but on equity substituted the penalty with withholding of pension beyond the minimum pension under the 1996 Pension Rules, payable from the date of the writ decision. Matters not addressed in the cited judgment text are not recorded here.
