Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Kerala High Court judgment.
The judgment of the Kerala High Court records the following account. Assistant Sub-Inspector of Pandalam Police Station was convicted for demanding and receiving illegal gratification to release an autorickshaw involved in an accident. The officer accepted Rs. 500 initially and was caught red-handed in a vigilance trap while receiving the remaining Rs. 500 at Prakash hotel. The Kerala High Court confirmed the conviction under Sections 7 and 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, holding that the prosecution satisfactorily established the trap. Considering the appellant's age and lapse of time, the High Court reduced the substantive sentence of imprisonment to one year on each count to run concurrently, while maintaining the fines.
