CW-2008-0005Supaul, BiharJudgment 29 February 2008

Jadia Police Constable vs State Of Bihar And Ors.

The Patna High Court dismissed a writ petition filed by dismissed constable, upholding the order of dismissal passed by the Superintendent of Police, Saharsa with effect from November 1, 1987. A departmental inquiry established that on the night of July 31, 1986, the petitioner brought alcohol into Jadia Police Station, drank there, assaulted civilian a Jadia man inside the station, and hurled abusive language at the Inspector and Sub-Inspector when restrained. Holding that the inquiry was conducted properly with full opportunity given to the delinquent officer and that severe indiscipline in a uniformed police force cannot be tolerated, the Court found the dismissal penalty fully commensurate with the misconduct. Matters not addressed in the cited judgment text are not recorded here.
