ConcludedThe trial court convicted the accused police personnel, as recorded in the Gujarat High Court judgment.
The Gujarat High Court held that theft suspect [name withheld], taken on seven days' police remand on 10 January 1989, died a homicidal custodial death with 34 ante-mortem lathi injuries while in the custody of PSI of the Naranpura Surveillance Squad. The Court rejected [name withheld]'s defence that the deceased fell on iron fencing while escaping, finding the death occurred in his exclusive custody. It altered his murder conviction to Section 304 Part II read with Section 34 IPC and sentenced him to three years' rigorous imprisonment with a Rs 5,000 fine, while confirming the convictions for evidence-tampering under Sections 201 and 193 IPC. The Court dismissed the State's appeal against the acquittal of the co-accused policemen for want of proof of their presence.
