CW-2007-0032Nagpur, MaharashtraJudgment 13 December 2007

Nagpur Police Police Inspector and others vs State of Maharashtra

The Bombay High Court (Nagpur Bench) upheld the conviction of nine Nagpur Crime Branch policemen under Section 330 IPC for custodially torturing a Nagpur man, picked up from his home around 1 a.m. on 24 June 1993 and found dead in the lock-up that morning with 23 injuries. The Court dismissed the State appeals against acquittal for murder and for enhancement, acquitted the nine of the ss.354/355/342 charges and acquitted A-10 (Raghunath Bhakte) entirely. The Supreme Court (Yashwant Etc. vs State of Maharashtra, 4 September 2018) sustained the s.330 guilt, rejected the superior-orders defence, and enhanced the 3-year sentence to seven years rigorous imprisonment; A-1's appeal had abated on his death.
