Pooyappally Man vs Pooyappally Man

The judgment of the Kerala High Court records the following account. On 1 June 1993, auto-rickshaw driver [name withheld] was taken to Pooyappally police station after failing to stop instantly at a constable's signal, and inside the station constable slapped him on the left ear, causing bleeding and hearing loss that needed inpatient ENT treatment till 11 June 1993. The driver filed a private complaint, and the trial and appellate courts convicted the constable under Section 323 IPC with release on probation. The Kerala High Court held the complainant's version was supported by an independent occurrence witness and medical evidence, and dismissed the revision. The court confirmed the conviction, the probation release and Rs.1,000 compensation, remarking the appellate court had taken a very lenient view. Matters not addressed in the cited judgment text are not recorded here.
