Order issued
ConcludedThe Gujarat High Court recorded adverse findings against police personnel and ordered Rs 160,000.
The Gujarat High Court held it established that a Vadodara man, 42, died following illegal detention and ill-treatment at Makarpura police station, Vadodara. The Court found he was picked up on 16 September 1994 without any complaint against him, detained under Section 151 CrPC in a small room with many others, beaten, and denied medicines, water and medical aid despite his known heart ailment, dying on 17 September 1994. It noted a Section 176 magisterial inquiry substantiating beating and negligence was buried while a departmental inquiry exonerated all. Holding the Article 21 violation established, the Court directed Rs 40,000 interim compensation to each of the four petitioners plus Rs 10,000 costs, and ordered the widow complaint to be registered as an FIR for independent investigation.
