CW-2007-0001Balasore, OdishaJudgment 2 February 2007

Simulia Man And Ors. vs State Of Orissa And Ors.

The judgment of the Orissa High Court records the following account. On 6 February 2002 Simulia police chasing the Dolphine Dynamic bus fired aimlessly at it near Dhobagadia crossing on NH-5 after the driver failed to stop, killing passenger a Simulia man, aged about 35, with a chest gunshot. A criminal case under IPC 304 against Simulia police personnel ended in acquittal, but the OIC admitted in counter-affidavit that a Simulia man died in the police firing. The High Court held that the death resulted from the irresponsible and negligent act of the police and that compensation under Article 226 was appropriate where negligence was writ large. It fixed Rs. 5 lakh as just compensation, directing payment of the Rs. 2.5 lakh balance within three months after adjusting Rs. 1 lakh ex gratia and Rs. 1.5 lakh interim already paid. Matters not addressed in the cited judgment text are not recorded here.
