ConcludedThe Jharkhand High Court upheld service punishment imposed on police personnel.
The Jharkhand High Court (M.Y. Eqbal J.) on 14 November 2006 dismissed the appeals of CISF constables and Naik of the Kargali colliery check post against their dismissal from service. The court recorded that surprise checks on 21 and 24 November 1997 found them collecting Rs. 50 and Rs. 65 respectively as illegal gratification from unidentified truck drivers and khalasis, for which they were charge-sheeted for gross misconduct, indiscipline and dereliction of duty and dismissed after a departmental inquiry. The court agreed with the Single Judge that the small sums recovered did not make the proved allegations any less grave for CISF constables, and that courts must not lightly interfere with punishments imposed after a properly conducted enquiry in disciplined services. It held the penalty of dismissal commensurate with the charges and dismissed both appeals, so the dismissals stand.
