Order issued
ConcludedThe Gauhati High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The Gauhati High Court held that a police party led by Additional SP picked up a Bokajan woman in an injured condition during an anti-insurgency operation in the Kalapahar forest on 20 April 2005, in front of villagers, and never produced her before any Magistrate. The Court raised the presumption that she had been liquidated in custody and described the violation of Article 21 as patent, incontrovertible and conscience-shocking. It awarded Rs 2,00,000 in compensation, payable by the State but recoverable from the officers responsible, together with Rs 10,000 in costs. It further directed the Director General of Police to register a case within a week and entrust the investigation to the CBI. Matters not addressed in the cited judgment text are not recorded here.
