ConcludedThe Chhattisgarh High Court recorded adverse findings against police personnel and ordered Rs 1,000,000.
The Chhattisgarh High Court (Division Bench) allowed a public interest writ highlighting the custodial death of a Suhela, village Bhalesur man, a 26-year-old tribal agricultural labourer, at Police Station Suhela. Picked up on suspicion of petty theft of goods worth Rs. 972, he was illegally detained without arrest being recorded, mercilessly beaten by ASI and other staff, paraded handcuffed through villages on August 11, 2004, and found dead in the lock-up toilet on August 13, 2004 in a staged hanging the Court disbelieved, with a false autopsy prepared at the ASI's behest. Holding the State liable in public law, the Court directed payment of Rs. 10,00,000 compensation to the widow and three minor children within a month (sums already paid adjusted), ordered the CBI to register a case and investigate, and directed departmental enquiries against the six named police personnel.
