CW-2006-0004Patna, BiharJudgment 31 March 2006

Danapur Man v. State of Bihar & Ors.

The Patna High Court held the State liable for the homicidal custodial death of a Danapur man, whose injured dead body came out of police custody in June 1998 after he was kept overnight at Danapur and then remanded to jail. The Court found the post-mortem showed injuries that would cause homicidal death, and that the Investigating Officer deliberately delayed forwarding viscera to the FSL by 18 months so the cause of death could never be known, while superiors stood by silently. It assessed Rs 5 lakh nominal damages payable within three months. The State was directed to recover the sum from the person or persons at fault. Matters not addressed in the cited judgment text are not recorded here.
