Order issued
ConcludedThe Delhi High Court recorded adverse findings against police personnel and ordered Rs 50,000.
A Delhi man alleged he was picked up on 3.10.2004 by two PS Bara Hindu Rao officials and mercilessly beaten and tortured in custody, despite an earlier High Court protection order against police harassment. The status report showed he was arrested by SI under Sections 107/151 CrPC without sufficient reasons, was not medically examined on lock-up entry, and the Body Inspection Memo showed no injury while the hospital MLC recorded beating in police custody with bruises, contusion and swelling. The Court held a prima facie case of police brutality and custodial torture was made out. It directed registration of an FIR to be investigated by the District Investigating Unit (North) and Rs 50,000 ex gratia ad interim compensation recoverable from the delinquent policeman, expressly without prejudice to the merits. Matters not addressed in the cited judgment text are not recorded here.
