CW-2005-0015JharkhandJudgment 25 July 2005

CISF Constable vs Union of India and Others

The Jharkhand High Court (M.Y. Eqbal J.) on 25 July 2005 dismissed the writ petition of CISF constable (No. 8017761) against the rejection of his revision by the Inspector General, CISF Eastern Sector. The court recorded the same history as the later appeal round: dozing on watch-tower duty on 11/12 February 1992 and assaulting Inspector, both charges proved, dismissal on 12 October 1992, and the Division Bench in LPA No. 646 of 2002 restoring dismissal while allowing a revision on quantum only. The court held that dismissal on proved misconduct cannot be interfered with on sympathetic grounds unless illogical, procedurally improper or shocking to conscience. Declining to interfere, it dismissed the writ petition; a further appeal in the same matter was dismissed on 8 March 2006 (recorded as CWC-0993).
