CW-2005-0012DelhiJudgment 17 May 2005

Delhi Police Constable (Executive) and others vs NCT of Delhi and Others

Constable (Executive) [name withheld] was dismissed on 10.11.2001 after departmental proceedings found he had secured enrolment in the Delhi Police with forged high-school and intermediate certificates showing date of birth 02.01.1971, though Board records and his genuine character certificate showed 01.04.1969, and had withdrawn the originals from his character roll in 1995 on a false pretext. His departmental appeal and CAT Original Application were dismissed. The Court held the forgery proved by Madhyamik Shiksha Parishad documentary evidence, rejected procedural challenges on non-supply of documents and non-examination of witnesses, and found no infirmity in the Tribunal order. The writ petition was dismissed and the dismissal from service stands. Matters not addressed in the cited judgment text are not recorded here.
