CW-2005-0008East Khasi Hills, MeghalayaJudgment 5 August 2005

Shillong Man vs State of Meghalaya and Ors.

The Gauhati High Court (single judge) held that 23-year-old businessman [name withheld], brutally assaulted by on-duty police at the Rangali Bihu venue on the night of 15-04-2002 and taken to the Laitumkhrah Beat House, died of those injuries on 18-04-2002. Relying on the magisterial enquiry and post-mortem report, the court rejected the SP's cover-up affidavit based on falsehood and held the State failed to discharge its burden. Finding an Article 21 violation, it awarded another Rs 1.5 lakh over the Rs 1 lakh ex gratia already paid (Rs 2.5 lakh total), payable within two months. A murder case (Laitumkhrah PS Case 25(4)02 under Section 302 IPC) was already registered. Matters not addressed in the cited judgment text are not recorded here.
