ConcludedThe Gujarat High Court upheld service punishment imposed on police personnel.
The Gujarat High Court (Anant S. Dave, J.) on 9 December 2004 rejected the Article 226 petition and confirmed the dismissal from service of subordinate police officer ordered on 31 May 1989 by the District Superintendent of Police. A departmental inquiry (conducted by the Deputy Superintendent of Police, Tharad Division) had held proved the charge that he brought a tribal woman to police quarter Room No. 59, 'C' Block, with ill-intention, framing it as moral turpitude and conduct unbecoming a member of the police force. The court held the charge conclusively proved on reliable evidence, found no illegality in the disciplinary, appellate and revisional orders, and refused to substitute a lesser punishment. The dismissal had already survived departmental appeal, revision to the Director General of Police and a second revision to the Home Department.
