CW-2004-0014Patna, BiharJudgment 8 September 2004

Railway Police personnel vs State of Bihar and Others

The judgment of the Patna High Court records the following account. On 21 December 1996 the Superintendent of Railway Police, Patna, with a police force caught railway policeman at Bakhtiarpur Railway Station collecting money from Patna-Mokama train passengers. After a departmental inquiry found the charges proved he was dismissed; in appeal the dismissal was modified to compulsory retirement under Rule 854(A)(6) of the Bihar Police Manual. The Patna High Court (Narayan Roy, J.) held that the accompanying police party had proved the charges, that the authorities had applied the rules of law and observed natural justice, and that substituting compulsory retirement for dismissal was already a lenient view. Finding no ground to interfere, the court dismissed the writ petition on 8 September 2004. Matters not addressed in the cited judgment text are not recorded here.
