Order issued
ConcludedThe Patna High Court recorded adverse findings against police personnel and ordered Rs 75,000.
A tractor (BR-08-0855) with thrasher seized by the District Transport Officer was handed to Sindhaul Police Station, Begusarai, for safe custody on 29 March 2001; after the owner deposited tax and fine and obtained a release order, the tractor was found stolen from the station on 8 April 2001, with the FIR lodged only months later. The petitioner also alleged the officer-in-charge demanded illegal gratification for release, which the court did not need to decide. The Patna High Court (Chandramauli Kumar Prasad, J.) rejected the State's sovereign-immunity defence, held the theft occurred on account of the failure, negligence and dereliction of duty of police-station staff, and directed the State to pay Rs 75,000 plus Rs 5,500 costs within eight weeks, with liberty to recover from the erring person. The court observed that withholding two increments for such dereliction was grossly inadequate, while declining to fix individual responsibility. Matters not addressed in the cited judgment text are not recorded here.
