ConcludedThe Delhi High Court upheld service punishment imposed on police personnel.
The Delhi High Court Division Bench (S.B. Sinha, C.J. and A.K. Sikri, J.) on 31 May 2002 dismissed the writ petition against the CAT order in OA No. 2696 of 2000 and left intact the dismissal of Delhi Police personnel for forcibly snatching Rs 40,000 from train passenger a Delhi resident in the wee hours of 30 September 1993. The court held the dismissal of 2 December 1998 had attained finality before the criminal acquittal of 7 December 1999 and could not be reopened on that subsequent event, and that simultaneous departmental and criminal proceedings are not barred. It held the inquiry evidence, including recoveries of Rs 13,000 at the instance of each delinquent and the evidence of PWs 3 and 4, sustained the charges on preponderance of probability. The court found no case for interference under its limited judicial review jurisdiction and dismissed the petition. Matters not addressed in the cited judgment text are not recorded here.
