ConcludedThe Allahabad High Court recorded adverse findings against police personnel and ordered Rs 250,000.
The judgment of the Allahabad High Court records the following account. A Golhaura man, aged 27, was arrested on 14 October 1998 in a kidnapping case and kept in the Golhaura police lock-up for three days, where the family alleged he was beaten to death. Police claimed he hanged himself, obtained a post-mortem report of hanging and cremated the body; an FIR for murder was later registered against police personnel on a Section 156(3) Cr.P.C. direction. The Division Bench rejected the suicide plea as too big a pill to be swallowed, held the police officers and the autopsy doctor acted hand in glove to fabricate the post-mortem report, and found D.K. Basu safeguards violated. It allowed the writ petition, directed Rs. 2,50,000 compensation (Rs. 1,50,000 to parents, Rs. 1,00,000 to the widow) recoverable from the responsible police officers, and left criminal liability to the pending CBCID murder investigation.
