ConcludedThe Andhra Pradesh High Court recorded adverse findings against police personnel and ordered Rs 75,000.
The High Court found that police personnel of II Town Police Station, Rajahmundry dragged a Rajahmundry man from his house on 8 August 1999, illegally detained him, and beat him with lathis for about four hours in the station causing multiple injuries. Accepting the enquiry report of the Chief Judicial Magistrate, which examined 23 witnesses and rejected the officers alibi defence, the Court held the torture violated the petitioner fundamental right under Article 21 regardless of his alleged bootlegging record. The Court directed the State to pay Rs 75,000 compensation plus Rs 2,500 costs to the Legal Services Authority, to fix individual responsibility and prosecute the guilty personnel, with liberty to recover the amount from them.
