ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The Bombay High Court (Aurangabad Bench) held that an Aurangabad man, arrested on 30-10-1994 and found dead in the Kranti Chowk lock-up on the night of 8/9 November 1994 after about ten days in custody, died a homicidal custodial death following torture. The court rejected the police suicide-by-hanging story as physically impossible and a concocted cover-up, distrusted the CID inquiry as disguising police sins, and called the inquest dishonest. Holding the State liable in public law, it awarded Rs 2 lakh compensation (Rs 50,000 cash to the widow, Rs 1.5 lakh in fixed deposit for the children) plus Rs 5,000 costs. It further directed the CBI to register a case, investigate and prosecute those responsible, and ordered disciplinary proceedings against them.
