State of West Bengal & Ors. v. Barrackpore Police Deputy Superintendent of Police (retired)

The judgment of the Calcutta High Court records the following account. While Chief Law Instructor at the Police Training College, Barrackpore, DySP [name withheld] demanded Rs. 6,000 from Cadet SI on 9 October 1980 on the false plea of placating the DIG (Training) and accepted it on 13 October 1980, besides attempting a further Rs. 4,000. A Vigilance Commission enquiry found him guilty of both charges, and the Governor permanently withheld 50% of his pension with effect from 1 March 1982. The West Bengal Administrative Tribunal set aside the cut, but the Calcutta High Court held Rule 10 of the WBS (DCRB) Rules, 1971 permits post-retirement pension action and set aside the Tribunal's order. The Governor's pension-withholding order was affirmed on 21 September 2001. Matters not addressed in the cited judgment text are not recorded here.
