ConcludedThe Karnataka High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The judgment of the Karnataka High Court records the following account. A Kalaburagi man, who had demanded back Rs 25,000 paid for a promised job, was falsely implicated at the recipient's instance, illegally detained at Chowk PS from 16 May 1992, briefly escaped, was handed by the ASI to PSI, and died in the Station Bazar lock-up on 19 June 1992. On the undisputed COD report, the Karnataka High Court found month-long illegal detention without production before court in conspiracy with the complainant, and fixed tortious liability on the State. The court awarded the mother 2 lakh with 6 percent per annum interest from the date of illegal detention, ordered the State to recover proportionately from the guilty personnel, and directed disciplinary proceedings within four weeks. The pending Sessions trial against 22 charge-sheeted accused was left to proceed independently.
