CW-2000-0009West Delhi, DelhiJudgment 27 November 2000

Government of NCT of Delhi vs Nasiruddin (father of deceased [name withheld]. Tihar Man)

The judgment of the Delhi High Court records the following account. A Tihar man, about 21, was picked up by police on 15 April 1996, lodged in Tihar Jail and died there on 13 July 1996 with 15 ante-mortem injuries; a government medical board conceded several injuries could not have been self-inflicted. The State claimed he was a violent psychiatric patient injured while being restrained. The Division Bench rejected that plea, holding doctors examining him over 8-13 July 1996 could not have missed the injuries, and affirmed State liability in public law for the custodial death. It reduced compensation from Rs.2.5 lakh to Rs.2 lakh (Rs.1,25,000 already paid). Erring officials were not individually named. LPA against W.P.(Crl.) No.585/1996 judgment dated 16.12.1997. Matters not addressed in the cited judgment text are not recorded here.
