ConcludedThe Rajasthan High Court recorded adverse findings against police personnel and ordered Rs 300,000.
The Jaipur Bench of the Rajasthan High Court allowed an Article 226 writ petition filed by Mst. Madina, the 23-year-old widow of a Kuchaman City man, who died in police custody within three hours of being detained on 17 June 1997 for alleged theft of a guar gum bag. The post-mortem examination revealed that a Kuchaman City man died from haemorrhagic shock resulting from kidney injuries sustained through third-degree torture at Kuchaman City Police Station. Rejecting the State argument that disputed facts barred writ jurisdiction, the Court held that the custodial death was undisputed on record and directed the State of Rajasthan to pay Rs. 3,00,000 as interim compensation to the widow and four minor children, with directions to recover the amount proportionately from the erring police officers.
