ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 150,000.
The judgment of the Bombay High Court records the following account. A Shahapur man, aged 21, was arrested on 10 June 1997 in a robbery case and remanded to police custody, where his wife alleged he was subjected to third-degree torture from 11 to 16 June 1997 until he died on the night of 16 June. Police claimed he strangled himself with a floor mat, but a second post-mortem ordered by the JMFC contradicted suicide, and the State's affidavit almost conceded torture in custody. Offences under Sections 330, 306 and 323 read with Section 34 IPC were registered against the three named officers. The Court held the death a custodial death caused by police torture, awarded Rs. 1,50,000 compensation plus Rs. 10,000 costs recoverable from the erring officials, and directed their suspension pending criminal trial or departmental enquiry.
