Mhow Man v. State of Madhya Pradesh & Ors.

On 21 August 1993 the Madhya Pradesh High Court allowed the Article 226 petition of Abdul Ghaffar, whose son [name withheld] was picked up by Mhow police on the night of 15 August 1992, shown arrested only on 18 August 1992 in a Section 457 IPC case, and found dead with multiple injuries in the Civil Hospital mortuary on 19 August 1992. The court ordered registration of offences under Sections 302 and 387 IPC with investigation in accordance with law, and deprecated the five autopsy doctors for withholding the cause of death before the court summoned the viscera report. Relying on the Rudul Shah line of cases, the court awarded Rs. 1,00,000 as exemplary compensation payable by the State, recoverable from those found responsible, plus Rs. 2,500 counsel's fee.
