CW-1993-0008Ahmedabad, GujaratJudgment 18 January 1993

Ahmedabad Police Unarmed Head Constable vs State of Gujarat and Anr.

The petitioner, an Unarmed Head Constable, was convicted with three others in Sessions Case No. 187 of 1980 under Section 331 read with Section 34 IPC for custodial torture inflicted to extract a clue to stolen property, and sentenced to 3 years rigorous imprisonment and a fine. The court recorded that the conviction was confirmed by the High Court and the Supreme Court, after which the District Superintendent of Police, Ahmedabad (Rural) dismissed him from service in 1984. The High Court held the DSP was the competent authority, the show-cause process was valid, and dismissal for such serious misconduct warranted no interference under Articles 226/227. The writ petition was dismissed and the dismissal from service stands. Matters not addressed in the cited judgment text are not recorded here.
