CW-1993-0001Cuttack, OdishaJudgment 11 January 1993

Cuttack Man v. State of Orissa & Anr.

The Orissa High Court awarded Rs 10,000 to a Cuttack man, aged about 18, who was handcuffed and put in chains while hospitalised in the surgery ward of SCB Medical College Hospital, Cuttack, on a Havildar's orders. The Court rejected the justification of unknown anti-social visitors as ipse dixit, holding the chaining uncalled for, ordered by an incompetent rank since only a Deputy Superintendent may order irons under section 56 of the Prisons Act. It held the Orissa Police Manual stood unamended despite Sunil Batra and found a clear violation of Article 21. The State was left free to proceed against the Havildar under law. Matters not addressed in the cited judgment text are not recorded here.
