ConcludedThe Orissa High Court recorded adverse findings against police personnel and ordered Rs 30,000.
The judgment of the Orissa High Court records the following account. A Jajpur Road man, accused in a dacoity case, was arrested and brought to Jajpur Road Police Station on 23 August 1990, where police alleged he committed suicide by hanging inside the station latrine at 5:15 AM the next morning. Although a magisterial inquiry accepted the suicide theory, the Orissa High Court analyzed medical evidence—specifically 300 cc of undigested stomach contents contradicting the 9:00 PM feeding time and suspicious haste in cremating the body with police photographing the funeral pyre—and rejected the suicide claim. The High Court concluded that the deceased died due to police torture in custody in clear violation of Article 21. The Court held the State vicariously liable and directed payment of Rs. 30,000 compensation (Rs. 10,000 to the father and Rs. 20,000 to the young widow).
