CW-1991-0001Solapur, MaharashtraJudgment 19 March 1991

State of Maharashtra and Ors. vs Solapur Man

The judgment of the Supreme Court of India records the following account. Undertrial prisoner Ravikant Patil, arrested in Karnataka in a murder investigation, was handcuffed with both arms tied by rope and paraded through the main squares of Sholapur on 17.8.1989, after a local paper announced the parade. The Bombay High Court held Inspector had subjected the undertrial to unwarranted humiliation and indignity violating Article 21, awarded Rs 10,000 compensation against the officer personally, and directed an adverse service-record entry. The Supreme Court agreed the Inspector's explanation was wholly unacceptable and sustained the compensation, but held the officer acted in official capacity so the State of Maharashtra must pay, as in Rudul Sah. It left open a departmental inquiry into further action against the officer after hearing him.
