ConcludedThe Punjab and Haryana High Court recorded adverse findings against police personnel and ordered Rs 25,000.
The Punjab and Haryana High Court held Sub-Inspector, SHO of Police Station Sadar Zira, guilty of the illegal arrest of a Zira man, taken from his home at 6 a.m. on 3 July 1987 and seen behind bars at the police station before his whereabouts became unknown. Accepting the District and Sessions Judge Ferozepore's enquiry report, the court rejected the respondent's alibi built on daily-diary entries, observing such entries can be manufactured where a person is illegally arrested with an ulterior motive such as elimination by false encounter. Since it was unascertained whether the detenu was alive or dead, the court directed SI to deposit Rs 25,000 as interim compensation and consigned the petition with liberty to revive it and seek further compensation if elimination is established. Matters not addressed in the cited judgment text are not recorded here.
