CW-1986-0002Patiala, PunjabJudgment 20 August 1986

State of Punjab and Others v. Punjab Police Constable

The Punjab and Haryana High Court sustained the dismissal of Punjab Police constable of Patiala, who had been dismissed on 1 April 1981 by the Additional Superintendent of Police after a departmental enquiry found wilful absence without permission in order to avoid a Refresher Course. The court held the Additional Superintendent of Police has concurrent powers with the Superintendent of Police under s.7 of the Police Act, 1861, so the order was passed by the competent authority. Noting the constable had earned six punishments in ten years of service and was recorded as incorrigible, the court held the punishment called for no interference. It set aside the lower appellate decree that had quashed the dismissal and dismissed the constable's suit; a pure service matter with no citizen victim. Matters not addressed in the cited judgment text are not recorded here.
