Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Punjab and Haryana High Court judgment.
SHO of Police Station City Bhiwani arrested complainant [name withheld] on 3 May 1980 after a gold-smuggling search of his shop and house recovered nothing, and the judgment records that the SHO tortured him in custody to extort money before handing him to Central Excise inspectors who also beat him. The Chief Judicial Magistrate, Bhiwani, convicted the SHO under Sections 330 and 323 IPC on 17 November 1980 but released him on one year's probation, and both sides' appeals were dismissed by the Additional Sessions Judge. In revision the High Court held that probation had been granted without calling for the Probation Officer's report, in breach of the mandatory Section 4(2) of the Probation of Offenders Act, 1958. It left the conviction undisturbed, set aside the probation orders, and remanded the case to the trial court for fresh orders on sentence.
