Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Orissa High Court judgment.
The judgment of the Orissa High Court records the following account. Nine Nuagaon police personnel were tried for confining theft suspects a Nuagaon man and a Nuagaon man in the lock-up without arrest from 27-07-1975, torturing them, and, after a Nuagaon man died, hanging his body from a tree to fake suicide. The trial court acquitted them of murder (302), grievous hurt (331) and hurt (323) but convicted all under Section 201 IPC, the OIC and ASI under Section 203, and OIC Trinath Dash under Section 342 IPC. The Orissa High Court dismissed the Government appeal against the acquittals and set aside all Section 201/203 convictions, holding murder/culpable homicide unproved and mere shifting of the body no disappearance of evidence. It upheld only OIC Trinath Dash's conviction for wrongful confinement under Section 342 IPC (fine Rs 500, default 3 months RI), the sentence being not severe.
