Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Allahabad High Court judgment.
The judgment of the Allahabad High Court records the following account. Head Constable Vishnu Prasad, in charge of police outpost Runkata under Achhnera Police Station in Agra, forcibly took complainant, a Runkata woman, from her home to a culvert outside her village and demanded a bribe of Rs 500 (settled at Rs 125) to stop harassing her family and release her. The complainant reported the matter to the Anti-Corruption CID, Agra, and a trap was laid on 5 May 1977 near Sudhir Petrol Pump, where initialled currency notes were handed to the officer. When the trap party moved in, the appellant threw the notes under a cot, resisted custody, and fled from police custody. The Special Judge, Agra, convicted him under Sections 161 and 224 IPC and Section 5(2) of the Prevention of Corruption Act, 1947. On appeal, the High Court set aside the Section 161 IPC conviction (holding the extortionate act was an abuse of office rather than an official function), affirmed the convictions under Section 5(2) of the PC Act and Section 224 IPC, reduced the PC Act sentence to one year rigorous imprisonment, and directed that he be taken into custody.
