Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Rajasthan High Court judgment.
The judgment of the Rajasthan High Court records the following account. A Rajgarh man, wanted in a kidnapping case, was detained at Rajgarh police station from 25 June 1965; the SHO, head constable and constable took his cycle, Rs.200 and other articles without entering them in the arrest memo, and the SHO allegedly beat him on the night of 29-30 June to extort more money, leaving 17 contusions. The Special Judge convicted only Head Constable under Section 409 IPC and acquitted the other two. The Division Bench confirmed the 6 months rigorous imprisonment plus Rs.500 fine and ordered his surrender, dismissed the State appeal on conspiracy, hurt and corruption charges for want of evidence, and, the SHO having died, passed no verdict on the beating while deprecating third-degree methods.
