ConcludedThe Andhra Pradesh High Court upheld service punishment imposed on police personnel.
The High Court allowed the Government writ appeals and restored the October 1953 dismissal of Sub-Inspector and the constables serving under him, who stood convicted of moral-turpitude offences under Sections 331 and 348 IPC for custodial hurt and wrongful confinement to extort a confession. The Court held the January 1954 general amnesty on formation of Andhra State remitted only the sentences and did not wipe out the convictions, and that the Article 311(2) proviso permits dismissal on the ground of conduct leading to a criminal conviction. Since the officers had withdrawn their criminal appeals as not pressed, the Court held the convictions stood finally upheld and set aside the single Judge orders quashing the dismissals. The judgment does not name the station, district, victim, or offence date. Matters not addressed in the cited judgment text are not recorded here.
