CW-1958-0003Vadodara, GujaratJudgment 19 September 1958

Karjan Police Sub-Inspector of Police v. State of Bombay

The judgment of the Bombay High Court records the following account. Sub-Inspector of Karjan was found at a drinking party in Atali village on 31 January 1950, suspended, charge-sheeted for serious misconduct violating the prohibition-obedience circular, and removed from the force by Government resolution dated 5 April 1952. He sued, alleging denial of reasonable opportunity under Article 311(2) and double punishment. The Court held the departmental enquiry duly completed, the show-cause notice satisfied Article 311(2) with no second hearing required, and Government took a serious view of prohibition defaults. It dismissed the suit with costs, upholding removal. Matters not addressed in the cited judgment text are not recorded here.
