Rampur Police Police Jamadar v. The State of Kutch

The Supreme Court dismissed the special-leave appeal of Police [name withheld] of the Local Investigation Branch, Mandvi, upholding his conviction under Section 384 IPC. While checking passports at Rampur village on 16 April 1950, the Jamadar collected a Rampur man's passport and demanded Rs 800 for its return, which was paid on 18 April 1950. The Court held that the implied threat of prosecution and withholding of the passport constituted fear of injury for extortion. The sentence of twelve months' rigorous imprisonment and Rs 100 fine, confirmed by the Sessions Judge and the Judicial Commissioner of Kutch, stood affirmed. Matters not addressed in the cited judgment text are not recorded here.
