ConcludedThe trial court convicted the accused police personnel, as recorded in the Allahabad High Court judgment.
The judgment of the Allahabad High Court records the following account. Head Constable Mahfooz Ali, attached to Idgah outpost in Agra city, threatened complainant [name withheld] with prosecution under Section 420 IPC over a dispute regarding a promissory note, demanding Rs 50 (settled at Rs 20) as illegal gratification to submit a favourable enquiry report. An Agra man reported the extortion to town Congress representatives and the City Magistrate, leading to an anti-corruption trap on 11 October 1949 where marked currency notes were handed to the officer and recovered from his pocket. The Additional Sessions Judge, Agra, convicted him of criminal misconduct under Section 5(2) of the Prevention of Corruption Act, 1947, sentencing him to two years of rigorous imprisonment and a fine of Rs 200. On appeal, the Allahabad High Court dismissed the challenge, rejecting technical defences regarding habitual misconduct and statutory warnings under Section 7, and affirmed the conviction and sentence in full.
