Content creator prosecuted over allegedly obscene social media posts

Police in Agartala arrested a woman content creator in October 2025 over allegedly obscene posts on social media. The High Court recorded two FIRs and later chargesheets and, by a Division Bench judgment of 12 August 2026, refused to quash them and ordered further investigation with a supplementary chargesheet.

How we verify →

FIRs and chargesheets survive; the High Court ordered further investigation and a supplementary chargesheet before the trial court.

What happened

The High Court recorded that two cases were registered at East Agartala and West Agartala police stations as case numbers 2025EAG108 and 2025WAG113, under defamation provisions and Section 67 of the IT Act, with chargesheets filed in late December 2025.

Northeast Today reported that West Agartala police searched a home in the Jogendranagar area and took the content creator into custody on the prior evening after a complaint from a local resident about allegedly indecent material shared online, with judicial production planned.

LawTrend reported that the accused was given temporary release on 7 January and continuing release on 13 February after the inquiry ended, and then asked the High Court to cancel the complaints as personal views lacking defamation ingredients.

The High Court held that a prima facie case remained, that fast-spreading online posts could injure reputation, and that the trial court should proceed after further investigation and a supplementary chargesheet, leaving the accused free to raise defences at trial.

What the record says

“In view of the above discussions, this Court is not inclined to quash the FIRs and the charge sheets at this stage.”

No complaining victim

The prosecution punishes allegedly obscene and derogatory social media posts by an adult; there is no violence, fraud, minor, coercion, trafficking, cruelty or spurious product, so the only harm alleged is to reputation and public sentiment.

What we could not confirm

Exact dates of the social media posts were not confirmed; incident_date left null. Later High Court scheduling orders of 14 September 2026 in State petitions (Crl.Petn. 12 and 14 of 2026) only adjourned matters to 1 October 2026 and add nothing on merits.
